To ensure data protection on our website, OpenStreetMap is deactivated when you first enter our website. A direct connection to the OpenStreetMap servers is only established when you activate OpenStreetMap yourself (consent according to Art. 6 Para. 1 lit. a DSGVO). This prevents your data from being transferred to OpenStreetMap when you first enter the page.

During subsequent interactions on this website, such as searching for breeder location, region, continent or horses for sale in your area, services of the OpenStreetMap Foundation are used and displayed embedded. After activating OpenStreetMap, your IP address and other information about your behaviour on this website, among other things, will be forwarded to OSMF. B) MapBox (with consent)
We use MapBox API, a service provided by MapBox Inc (address: 740 15th Street NW, 5thFloor, Washington, District of Columbia 20005, USA) hereinafter only referred to as “MapBox”. We use MapBox to visually display geographical information. When using MapBox, MapBox also collects, processes and uses data about visitors’ use of the map functions.

To ensure data protection on our website, MapBox is deactivated when you first enter our website. A direct connection to the MapBox servers is only established when you activate MapBox yourself (consent according to Art. 6 Para. 1 lit. a DSGVO). This prevents your data from being transferred to MapBox when you first enter the page.

Certification under the EU-US-Datenschutzschild is no longer sufficient as a guarantee that MapBox complies with EU data protection requirements even when processing data in the USA. Rather, we would like to point out that the personal data transferred to the USA will be evaluated by the US authorities within the framework of American data monitoring programmes, and EU citizens will not have access to appropriate legal protection options.

The legal basis is Art. 6 para. 1 lit. f) DSGVO. Our legitimate interest lies in optimising the functionality of our website.

Through MapBox, a cookie is stored on your end device via your internet browser. This transfers information about your use of our website, including your IP address, to a MapBox server in the USA and stores it there. This data is processed for the purpose of displaying the website or ensuring the functionality of the MapBox service. Creating and using a breeder profile (registration)

Registration gives you the ability to create listings under your name, send requests to vendors, upload images and post comments.

Use of the contact form

Communication between customers

Sales advertisements
Customers can publish, edit or delete sales advertisements with us. The data is processed in accordance with Art. 6 Para. 1 lit. b) DSGVO.

The contents of the sales ads are publicly displayed on our platform and can be indexed by search engines.

Optionally, customers can also publish contact details such as telephone numbers or website addresses.

Public breeder profile
All customers with an active advertisement or premium customers create a public breeder profile on which the user name, the registration date, the currently placed sales advertisements and information about their own breeding are published.

Optionally, the profile can be enriched with numerous individual contents, which can be deleted by the customer at any time.

The profiles can be indexed by search engines.

The data is processed in accordance with Art. 6 Para. 1 lit. b) DSGVO.

10. chargeable services
When booking chargeable services, we process inventory data, contact data, content data, contract data, metadata and payment data for the purpose of fulfilling our contractual obligations and services pursuant to Art. 6 para. 1 lit. b. DSGVO.

In the case of optional payment by credit card, this takes place via a form provided by our service provider. They meet the strictest security requirements and are certified.

In the case of optional payment by PayPal, you will be redirected to the websites of PayPal (Europe) S.à r.l. et Cie, S.C.A.. With the following information we inform you about the contents of our newsletter as well as the registration, dispatch and statistical evaluation procedure and your rights of objection. By subscribing to our newsletter, you agree to receive it and to the procedures described.

Performance measurement – The newsletters contain a so-called “web beacon”, i.e. a pixel-sized file that is retrieved from the server of the dispatch service provider when the newsletter is opened. We process your personal data in compliance with the requirements of the European Data Protection Regulation (DS-GVO) and the national regulations on data protection (Federal Data Protection Act) to achieve the following purposes:
We process your personal data for the purpose of providing the content within our internet pages for retrieval by the user. The processing is carried out on the basis of Art. 6 para. 1 sentence 1 lit. b) DS-GVO.
The same applies to the processing of personal data on the occasion of the handling of your requests communicated via contact form or otherwise.
We also process your personal data for the purpose of processing contracts concluded with us (individual purchases and subscriptions) and for processing complaints. This processing is based on Art. 6 (1) sentence 1 lit. b) DS-GVO.

We also process your personal data if you have given us your consent to do so. In this case, the processing is carried out on the basis of Art. 6 para. 1 sentence 1 lit. a) DS-GVO. When obtaining consent, we will inform you of the specific purpose of the intended processing. You can revoke consent given to us at any time with effect for the future. This also applies to consent that you gave before 25 May 2018. We will inform you about the possibility of revoking consent in each case when consent is given.
Finally, we process your data where we have a legitimate interest in doing so, unless your interests or fundamental rights requiring the protection of your personal data override this. In this case, the processing is carried out on the basis of Art. 6 (1) sentence 1 lit. f) DS-GVO. Such processing includes the use of tools to evaluate your usage behaviour, the use of cookies or the integration of social media plugins within our websites.

Who do we share your data with?
Within Horsebreeder International, your data will be passed on to those specialist departments that need it to fulfil the contract or carry out pre-contractual measures (e.g. sales for enquiries about products and services on our website, accounting for processing orders). In addition, those departments that process your personal data on the basis of a legitimate interest, such as our marketing department for the interest-based display of advertisements, receive your personal data.

If necessary, we also pass on data to service providers who support us (e.g. IT service providers, debt collection service providers and legal advisors) in addition to the companies mentioned above.

Your data will be passed on to third parties outside Horsebreeder International to the operators of the trading platforms through which you purchase our products depending on the operating system of your end device (iTunes Store, Google Play Store), and if and insofar as there is a legal obligation to do so (e.g. law enforcement authorities).

In the event of a necessary disclosure to third parties (e.g. in the context of a product test or competition), we will obtain separate consent from you. Otherwise, no data will be passed on to third parties.

Will your data be transferred by us to an international organisation or to a third country?
We have involved the above-mentioned technical service providers in the processing of your data. Insofar as these process personal data of the users of our Internet pages in a country outside the states of the European Union (“third country”), we have indicated this with the service provider concerned.

If, in the future, we commission additional or other service providers to operate these websites that process the data of the users of our websites in a country that is not a member state of the European Union, this will only be done if it is established on the basis of a decision by the European Commission that an adequate level of protection exists in the third country in question (Article 45 of the GDPR) or, in the absence of such a decision, suitable guarantees exist for the protection of your data and enforceable rights and effective legal remedies are available to you (Article 46 of the GDPR). In any case, we enter into a commissioned processing agreement with these service providers based on the EU standard contractual clauses before transferring personal data.

How long do we store your data?
We store your personal data for the duration of your use of our website. If and insofar as your data is subject to tax law, commercial law or other statutory retention obligations, we store this data until the expiry of the aforementioned periods.

If we have also stored your data for the purpose of advertising on the basis of a legitimate interest, we will delete this data at the time when you object to further advertising. This does not apply as long as this data is subject to a statutory retention period. In this case, however, the data will be blocked from being used for advertising purposes.

According to legal requirements, the data is stored for 6 years in accordance with § 257 para. 1 HGB (commercial books, inventories, opening balances, annual financial statements, commercial letters, accounting vouchers, etc.) and for 10 years in accordance with § 147 para. 1 AO (books, records, management reports, accounting vouchers, commercial and business letters, documents relevant for taxation, etc.).

Information on data protection rights / supervisory authority
All users shall have the right to obtain information about their data stored by Horsebreeders International and the processing operations relating thereto in accordance with Article 15 of the German Data Protection Regulation (DS-GVO), the right to have their data corrected in accordance with Article 16 of the DS-GVO, the right to have their data deleted after performance of the contract in accordance with Article 17 of the DS-GVO, insofar as this does not conflict with any retention obligations, the right to restrict processing in accordance with Article 18 of the DS-GVO, the right to object in accordance with Article 21 of the DS-GVO and the right to data portability in accordance with Article 20 of the DS-GVO.

Insofar as you have given Horsebreeder International consent to data processing, you may revoke this consent at any time without affecting the lawfulness of the processing carried out on the basis of the consent until revocation.

Furthermore, you have the right to lodge a complaint with a competent data protection supervisory authority pursuant to Art. 77 DS-GVO.
